Corporate counsel (privacy) — HTC. The position will be based in Bellevue, Washington and will report to the senior counsel, privacy. The role will be to establish and maintain international privacy and data protection practices in support of all HTC business teams that collect, store, use, transfer, and/or distribute personal or other data around the globe. Responsible for supporting legal and business teams located in the Americas, Europe, Middle-East, Africa, and Asia to ensure all activities comply with relevant domestic and international privacy and data protection laws. Coordinating with other members of the legal and government relations teams to monitor and comment on privacy legislation and regulations that affect or are likely to affect HTC’s current and anticipated business priorities, and ensure relevant business units within HTC are apprised of all such privacy-related developments. Review and document internal and external procedures and controls for access to personal data to ensure compliance with all relevant privacy and data protection laws and contractual commitments. Identify relevant privacy and data protection issues including required privacy notices, regulatory filings, and relevant process and infrastructure requirements. Work with security to support security incident response management, including determining and drafting any required third party notifications and related communications. Draft internal education modules regarding privacy and data protection to provide subject matter knowledge to HTC personnel. Support the business and business counsel with the review and negotiation of applicable privacy and data protection language for affiliate, vendor, and customer agreements. The successful candidate will have: JD degree from a top, nationally-accredited law school and license to practice in at least one relevant jurisdiction. A minimum of 4 years’ privacy and data protection related experience, in a recognized law firm or as U.S. or EU-based in-house counsel in a major company with global  operations, with a strong emphasis on consumer transactions. Essential skills include exceptional written and verbal communication skills, attention to detail, good judgment, a team-oriented attitude, solid interpersonal and analytical skills, and the ability to handle multiple projects at one time. Knowledge of international data protection schemes and requirements for the transfer of data on an international basis including the EU Data Directive, PIPEDA, PIPA, APEC principles and other emerging privacy laws. Experience managing legal and business risks in a variety of commercial transactions where the collection, storage, use, and distribution of customer data are involved in a significant way. Experience reviewing, drafting, and negotiating contract terms on the collection, storage, use, transfer, and distribution of customer data. A proven track record of integrating with key business teams and earning and retaining their trust over time and an ability to provide innovative and practical legal advice.
