Western District’s 2013 Annual CLE and District Meeting for Judges and Lawyers

After receiving State of the Courts presentations by Chief Judge Marsha J. Pechman, Chief Judge Paul B. Snyder, and Circuit and Court of Appeals Executive Cathy Catterson, there will be the following CLE presentations:

Plenary Session No. 1 — Review of the Latest U.S. Supreme Court Cases. 
This session features Washington Solicitor General Noah Purcell (former law clerk to U.S. Supreme Court Justice David Souter).

Civil Breakout Session — Obtaining Civil Discovery from Social Media Entities. Today many litigants and witnesses are living their lives on Facebook, Twitter, and other social media sites. Social media sites contain a wealth of information about all of us, and practitioners are seeking discovery from social media providers with increasing frequency. Yet most practitioners are unfamiliar with the kind of social media evidence that is available, the procedures necessary to discover it, the constraints on the ability and willingness of providers to produce it, and the way in which courts are handling disputes over it. This breakout session will address the practicalities of social media discovery as well as broader issues such as ethical considerations and the appropriate line between private and public personal information. This session features the Honorable Robert S. Lasnik, U.S. District Judge for the Western District of Washington, Hemanshu Nigam, social media industry consultant and former in-house counsel for MySpace and Microsoft, and Floyd G. Short of Susman Godfrey LLP.

Criminal Breakout Session — Cyber Threats and Cyber Crimes. Where are cyber threats coming from today? How do and should corporations and governments respond? How does law enforcement investigate cyber crime? This session features Microsoft’s Head of Litigation David Howard as Moderator, Microsoft’s Senior Attorney handling worldwide security incident response processes and cyber-security work Cristin Goodwin, Assistant U.S. Attorney Kathryn Warma, FBI Supervisory Special Agent with the FBI cyber squad Timothy Wallach, and Supervising Special Agent for the Secret Service Electronic Crimes Task Force Kirk Arthur.

Plenary Session No. 2 — Defense of Marriage Act and Other Federal GLBT Issues. Washington extended civil marriage to same-sex couples in 2012. However, the federal Defense of Marriage Act (DOMA) currently prevents the federal government from recognizing marriages of same-sex couples in Washington. This session will examine DOMA’s impact on same-sex couples and issues arising in federal courts as a result of the law. It will also include a discussion of the cases argued in the U.S. Supreme Court in March challenging DOMA and California’s Proposition 8. This session features Seattle University Constitutional Law Professor Christian Halliburton, Northwest Immigrant Rights Project Legal Director Matt Adams, and Legal Voice Legal and Legislative Counsel David Ward.
