Fee Arbitration PanelThe WSBA Fee Arbitration Program maintains a panel of volunteer arbitrators. This Fee Arbitration Panel settles disputes between attorneys and clients regarding fairness of legal fees.The panel includes both lawyers and non-lawyers. Appointment is for a five-year term for which panelists may be reappointed. The arbitrators have training or experience in arbitration, are appointed by the WSBA Board of Governors, and have signed an oath of office to maintain the confidentiality of the proceedings. Arbitrators are assigned by the ADR Program Coordinator on a case-by-case basis. When the amount in dispute is less than $10,000, one lawyer-arbitrator hears the case. If the disputed amount is $10,000 or more, one lawyer-arbitrator and two non-lawyer lay-panelists are assigned. The lawyer-arbitrator is responsible for scheduling the hearing with the disputants and lay-panelists. He or she is also responsible for promoting the fairness and accessibility of the program to both lawyers and clients. Fee arbitration is not disciplinary or mandatory. It is voluntary, confidential, informal and an efficient method of resolving fee disputes. WSBA members in good standing may request appointment to the Fee Arbitration Panel by marking their preference on the Committee, Board and Panel Volunteer Application Form.
