April 12, 2007 - At the Supreme Court's April 4, 2007, en banc meeting, the Court adopted the WSBA's suggested amendment to RPC 1.8(e). This will revise the rule on lawyer-advanced court costs and expenses so that it is essentially identical to the pre-September 1, 2006, version of the rule. This amendment was prompted by the Department of Revenue's position that permitting a client's obligation to repay advanced court costs to be contingent on the outcome rendered such payments subject to Washington's B&O tax. The amendment will be effective upon publication in the advance sheets (which will occur in late April or early May).

The Supreme Court also approved for publication the WSBA's suggested amendment to RPC 1.15A(e), changing applicability of the new annual reporting requirement from all "property" to only "funds." This will be published in an upcoming advance sheet as a proposed amendment with a 60-day comment period. The Court's order also stays application of the existing reporting requirement pending action on the proposed amendment.
