At its meeting on Saturday, Dec. 4, WSBA's Board of Governors received the committee's recommendations on the legislative proposals considered by the committee this Fall. BOG approved all of the committee's recommendations.
Except for the proposal for a court house facilitator for guardians and probate, the proposals were approved by unanimous votes.
The facilitator proposal passed 7-4. The Nay votes opposed the proposal on the ground that the court can set up facilitators without legislation. They argued that legislation on the matter implies that legislation is required. Such an implication blurs the line between the court and the legislature and invades the province of the court.
